General Terms and Conditions of the Alpin Skischule (as of Oct. 2020)
Unless expressly agreed otherwise, our General Terms and Conditions apply to all business transactions between the Alpin Skischule and its customers. The company's business purpose is the operation of a ski and snowboard school with equipment rental.

SKISCHULE

1. Prizes

The course prices, including VAT, are as per the season's price list.

2. Registration

Due to the Covid-19 pandemic, we recommend registering online for our ski and snowboard courses on our website. In exceptional cases, you can also register by email, phone, or fax. Registration creates a binding agreement between the course participant and the AlpinSkischule . Minors can only be registered by their parents or legal guardians. On the registration form, please provide your address, the specific course, and the date. You will then receive a written booking confirmation. Registration is binding.
We reserve the right to cancel the course if the minimum number of participants is not reached. We will of course inform you of this and try to find an alternative.
We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

3. Course map

Upon payment for the course, the customer receives a course card, which they hand to the ski instructor before the course begins. The course card is non-transferable, valid only for the specified period, and non-refundable. Ski course days must be taken consecutively. Only paid course cards are considered confirmed bookings.
A refund of the course ticket in case of illness or injury can only be granted with a doctor's certificate.

4th ski course

If there are fewer than 5 course participants, the Alpin Skischule reserves the right to reduce ski course times.
Extending the ski course is possible from the 3rd day onwards after attending a course, at the extension rate according to the price list.
Children and young people under 18 years of age need written consent from their parents or guardians if they are allowed to ski or snowboard independently without supervision after the ski course has ended, at their own risk.

5. Disclaimer

Participation in winter sports involves risks. By registering for courses offered by the Alpin Skischule , participants agree that participation is at their own risk and that, provided reasonable care is exercised, the ski and snowboard instructors and those responsible cannot be held liable.
The Alpin Skischule and the affiliated rental shop are not liable for accidents (before, during and after ski lessons or rentals) or injuries to course participants.
Unless a breach of contract is alleged to be intentional or grossly negligent, liability for damages is limited to foreseeable, typically occurring damages. This also applies if the Skischule culpably breaches a material contractual obligation. A material contractual obligation exists if the breach relates to an obligation on whose fulfillment the customer relied and was entitled to rely. Liability for culpable injury to life, body, or health remains unaffected.
Unless otherwise stipulated in the General Terms and Conditions, liability for damages is excluded – regardless of the legal basis of the claim. This applies in particular to claims for damages arising from culpa in contrahendo (fault in contract formation), other breaches of duty, or tortious claims for compensation for property damage pursuant to Section 823 of the German Civil Code (BGB). Where liability for damages is excluded or limited with respect to the contractual partner, this also applies to the personal liability for damages of employees, workers, staff, representatives, and vicarious agents. The aforementioned provisions do not entail any shift in the burden of proof to the detriment of the customer.
When registering for a course, the customer must truthfully and comprehensively inform the Alpin Skischule about his skills and experience in the relevant snow sport (skiing, snowboarding, cross-country skiing).
Please have your ski equipment checked before the start of your course. A properly functioning and correctly adjusted safety binding with ski brakes is particularly important. The instructors at the Alpin Skischule are not liable for damages resulting from incorrectly adjusted or faulty equipment.
Each participant bears the risks typically associated with sporting activities. Participants are advised to arrange their own personal insurance coverage. In addition, accident, personal liability, daily sickness allowance, and disability insurance are recommended.
Punctuality at the meeting point (ski course, private lessons) is the responsibility of the customer. The Skischule accepts no liability for late arrivals at the agreed meeting point. No refund or credit of the course fee will be issued for cancellations during a course or for no-shows.
All accidents, accident involvements, and incidents of damage (personal injury/property damage) that occur during the rental period (ski rental) or during the ski course (Skischule) must be reported to the ski rental company or the Skischule Alpin writing within 24 hours. Otherwise, the customer irrevocably waives any and all claims against the Skischule or rental company.

6. Cancellation policy / Withdrawal / Cancellation / Force majeure

Cancellation of a booked course by the customer is free of charge up to 2 days before the course begins. For cancellations after 9:00 a.m. on the day before the course, 100% of the course fees will be charged.
A refund of the course ticket in case of illness or injury can only be granted with a doctor's certificate.
No refund will be given for failure to appear at the agreed appointment or for cancellation of an ongoing service.
The Skischule strives to create the best possible external conditions for providing its services, but naturally cannot guarantee them. If exceptional weather or snow conditions make it wholly or partially impossible to provide the booked services, the Skischule accepts no liability for the resulting service cancellation. The Skischule is under no circumstances liable for or obligated to provide compensation for cable car and lift failures or any resulting service cancellations.
We reserve the right to cancel the course if the minimum number of participants is not reached. We will of course inform you of this and try to find an alternative.

7. Regulations relating to Covid-19 / Cancellation / Withdrawal / Withdrawal

Customers can view and stay informed about the Alpin Skischule 's hygiene and safety concept at any time on our website. The same applies to our instructors. The applicable social distancing and hygiene rules must be observed. By signing a form before the start of the course, the customer confirms to the Alpin Skischule that they have not been in any high-risk area (according to the Robert Koch Institute list) within the last 14 days, that they are not currently in quarantine, that they are not exhibiting any symptoms associated with Covid-19, and that they have not had contact with anyone who has tested positive for Covid-19 within the 14 days prior to the start of the course. Customers are obligated to inform the Alpin Skischule immediately and truthfully of any infections or symptoms. Individuals infected with Covid-19 or exhibiting Covid-19 symptoms may not participate in the course. The Skischule Skischulethe right to exclude anyone from course participation at any time in the event of an infection or symptoms. In such cases, the regular cancellation policy applies. If a customer cancels due to a confirmed infection or symptoms, the cancellation policy applies. For customers under 18 years of age, this confirmation must be signed by a parent or legal guardian. 8. Payment

Course and rental fees can be paid by cash or debit card before the start of the course at the Skischule , or by bank transfer for online registration.

9. Lift fees

The cost of lift tickets and ski equipment is not included in the course fee.

10. Data protection

We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

11. Place of jurisdiction / Legal status

The place of jurisdiction is Garmisch-Partenkirchen. The parties agree to the application of German law.

SKI RENTAL

1. Equipment rental only against a deposit (ID card (EU), passport or security deposit).

2. By signing the rental agreement, the customer confirms its accuracy (number of equipment items, date of the first rental day, etc.). Subsequent claims are excluded.

3. Remember your ski number and memorize your equipment to avoid any mix-ups.

4. The numbers/barcodes on the skis must not be removed. Use of the equipment must be discontinued immediately if it no longer functions properly. Equipment is only rented out subject to our terms and conditions.

5. Careful and responsible handling of the equipment is mandatory. Do not ski or snowboard on closed slopes, roads, paths, or parking lots. Any visible damage to the base of the equipment will be charged at a minimum of €20. Damaged or missing equipment will also be charged (breakage, loss, damage of any kind beyond normal wear and tear). The customer reserves the right to prove that the Skischule incurred lower costs.

6. The Alpin Skischule does not accept returns of equipment belonging to third parties.

7. Upon return, each partial day counts as a full rental day.

8. For insurance reasons, the Alpin Skischule cannot perform any installations or adjustments on bindings/equipment belonging to third parties. Sports shops are the competent contact in these cases.

9. In the event of loss due to theft or total damage to the borrowed equipment, the customer will be charged the market value of the borrowed equipment.

10. The place of jurisdiction is Garmisch-Partenkirchen. The parties agree to the application of German law.
