General terms and conditions of the Alpin Skischule (as of October 2020)
Unless expressly agreed otherwise, our general terms and conditions Alpin Skischule The object of the company is the operation of a ski and snowboard school with rental services.

SKISCHULE

1. Prices

The course prices including VAT apply according to the price list for the season.

2. Registration

Due to the Covid-19 pandemic, we recommend registering online for our ski or snowboard courses on our homepage. In exceptional cases you can also register by email, telephone or fax. By registering, an obligation arises between the course participant and the Alpin Skischule . Minors can only be registered by their parents or legal guardians. When you register, you tell us the address, the respective course and the date. You will then receive a written booking confirmation. Registration is binding.
We reserve the right to cancel the course if a minimum number of participants is not reached. We will of course inform you about this and try to find an alternative.
We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

3. Course map

When paying for the course, the customer receives a course card, which he gives to the ski instructor before the course begins. The course card is non-transferable, only valid for the specified period and will not be refunded. The ski course days must be taken one after the other. Only paid course tickets are fixed bookings.
A refund of the course ticket in the event of illness or injury can only be granted with a doctor's confirmation.

4. Ski course

If there are fewer than 5 course participants, the Alpin Skischule the right to reduce ski course times.
An extension of the ski course is possible after a course has been attended from the 3rd day at the extension rate according to the price list.
Children and young people under the age of 18 need the written consent of their legal guardian if they are allowed to ski or snowboard independently without supervision after completing the ski course at their own risk.

5. Disclaimer

Practicing winter sports involves risks. anyone who takes part in offers from the Alpin Skischule agrees that participation in the course is at their own risk and, provided they exercise reasonable care, the ski and snowboard instructors and those responsible cannot be held liable.
The Alpin Skischule and the associated rental company are not liable in the event of an accident (before, during and after ski lessons or rental) or injury to course participants.
Unless an intentional or grossly negligent breach of contract is alleged, liability for damages is limited to foreseeable, typically occurring damage. This also applies if the Skischule culpably violates an essential contractual obligation. A material contractual obligation exists if the breach of duty relates to an obligation on the fulfillment of which the customer trusted and was entitled to trust. Liability for culpable injury to life, body or health remains unaffected.
Unless otherwise stipulated in the General Terms and Conditions, liability for damages is excluded - regardless of the legal nature of the claim asserted. This applies in particular to claims for damages arising from negligence when concluding the contract, due to other breaches of duty or due to tortious claims for compensation for property damage in accordance with Section 823 of the German Civil Code (BGB). To the extent that liability for damages towards the contractual partner is excluded or limited, this also applies with regard to the personal liability for damages of employees, employees, employees, representatives and vicarious agents. A change in the burden of proof to the detriment of the customer is not associated with the above regulations.
When registering for the course, the customer must truthfully and comprehensively inform Alpin Skischule
Please have your own ski equipment checked before the course begins. It is particularly important to have a properly functioning and correctly adjusted safety binding with ski stoppers. The teachers at the Alpin Skischule are not liable for damage caused by incorrectly adjusted or faulty equipment.
Each participant bears the risks typically associated with the sports activities themselves. The participant is advised to ensure personal insurance coverage. In addition, accident, personal liability, daily sickness benefit and occupational disability insurance are recommended.
It is the customer's responsibility to arrive at the meeting point (ski course, private lessons) on time. Skischule assumes no liability for arriving late at the agreed meeting point . If you cancel during an ongoing service or fail to appear on the agreed date, the course fee will not be refunded or credited.
All accidents, involvement in accidents and cases of damage (personal injury/property damage) that occur during the rental period (ski rental) or during the ski course ( Skischule ) must be reported to the ski rental or the Alpin Skischule in writing within 24 hours. Otherwise, the customer irrevocably waives any claims of any kind against the Skischule or the rental company.

6. Cancellation conditions / withdrawal / cancellation / force majeure

Cancellation of the booked course by the customer is free of charge up to 2 days before the start of the course. If canceled after 9:00 a.m. the day before, 100% of the course fees will be charged.
A refund of the course ticket in the event of illness or injury can only be granted with a doctor's confirmation.
There will be no refund if you do not show up at the agreed appointment or if you withdraw from an ongoing service.
The Skischule tries to create the best possible external conditions for its service provision, but of course cannot guarantee these. If exceptional weather or snow conditions make it completely or partially impossible to provide the booked services, the Skischule no liability for the loss of services. Skischule under no circumstances liable or obliged to provide compensation for failures of the cable car and lift systems or services lost as a result
We reserve the right to cancel the course if a minimum number of participants is not reached. We will of course inform you about this and try to find an alternative.

7. Regulations in connection with Covid-19 / cancellation / cancellation / withdrawal

Customers can view and inform themselves about the Alpin Skischule 's hygiene and protection concept on our homepage at any time. The same applies to our teachers. The applicable distance and hygiene rules must be adhered to. The customer confirms to the Alpin Skischule by signing before the start of the course that he has not been in any risk area (according to the RKI list) in the last 14 days, that he is not currently in quarantine, and that he does not have any symptoms associated with Covid-19 and that he has not had any contact with anyone who has proven to be positively infected with Covid-19 in the past 14 days before the start of the course. Customers are obliged to inform the Alpin Skischule immediately and truthfully in the event of infections or symptoms. Covid-19 infected people or people with Covid-19 symptoms cannot take part in the course. The Skischule can order exclusion from participation in courses at any time if an infection or symptoms are present. The regular cancellation conditions apply in the event of cancellation by the Skischule. If the customer withdraws due to infection or symptoms, the cancellation conditions apply due to the customer's cancellation. For customers under 18, this confirmation must be signed by their legal guardian. Further measures can be found in our hygiene concept.

8. Payment

The course and rental fees are paid by cash or EC payment before the start of the course at the Skischule or by bank transfer when registering online.

9. Lift fees

The costs for lift tickets and ski equipment are not included in the course fee.

10. Data Protection

We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

11. Place of jurisdiction / legal venue

The place of jurisdiction is Garmisch-Partenkirchen. The parties agree on the application of German law.

SKI RENTAL

1. Rental of equipment only against deposit (identity card (EU), passport or deposit).

2. With his signature, the customer confirms the accuracy of the rental or rental agreement (number of equipment, date of the first day of rental, etc.). Later complaints are excluded.

3. Remember your ski number and memorize your equipment to avoid confusion.

4. The numbers/barcodes on the ski must not be removed. Use of the equipment must be stopped immediately if it no longer functions properly. Equipment is generally only rented out under our terms and conditions (Terms and Conditions).

5. Careful and responsible handling of the equipment is mandatory. Do not ski or snowboard over closed slopes, roads, paths or parking lots. You will be charged at least €20 for any visible damage to the surface. You will also be charged for any damaged or missing equipment (breakage, loss, damage of any kind beyond normal wear and tear). The customer reserves the right to provide proof of lower expenses incurred by the Skischule .

6. The Alpin Skischule does not accept third-party equipment back.

7. When returning the rental, every day started counts as a full rental day.

8. For insurance reasons, the Alpin Skischule cannot carry out any assembly or adjustments to third-party bindings/equipment. Sports shops are the competent contact in these cases.

9. In the event of loss due to theft or total loss of the borrowed equipment, the customer will be charged the market value of the borrowed equipment.

10. The place of jurisdiction is Garmisch-Partenkirchen. The parties agree on the application of German law.
